1. Introduction and Acceptance

1.1. These Terms of Use ("Terms") govern your access to and use of the KKD eServices Portal ("Portal"), including all content, features, services, and functionalities offered on or through the Portal. The Portal is owned and operated by the KKD eServices Authority ("Authority," "we," "us," or "our"), a body constituted under the administrative framework of the Government of India.

1.2. By accessing, browsing, or using this Portal, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, and any other policies or guidelines published on this Portal. If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Portal.

1.3. Your continued use of the Portal following the posting of any amendments or modifications to these Terms shall constitute your acceptance of such changes. It is your responsibility to review these Terms periodically to remain informed of any updates.

2. Definitions

2.1. "Portal" refers to the KKD eServices website, its sub-domains, and all digital services accessible through the platform, including but not limited to mobile-responsive pages and application programming interfaces (APIs).

2.2. "Content" means all text, data, graphics, images, audio, video, software, documents, forms, notifications, and any other material published or made available on the Portal.

2.3. "User" refers to any individual, organization, government agency, or entity that accesses or uses the Portal in any capacity.

2.4. "Services" means the digital public services, informational resources, applications, and tools provided through the Portal.

2.5. "Personal Data" shall have the meaning ascribed to it under the Digital Personal Data Protection Act, 2023, and any rules framed thereunder.

3. Use of the Portal

3.1. The Portal is provided for lawful purposes only. You agree to use the Portal solely for the purpose of accessing public services, obtaining information, and engaging with the digital governance tools made available herein.

3.2. You shall not use the Portal in any manner that could damage, disable, overburden, or impair the Portal's servers or networks, or interfere with any other party's use and enjoyment of the Portal.

3.3. Unauthorized access or attempted unauthorized access to any portion of the Portal, its servers, or any systems connected to the Portal is strictly prohibited and may constitute an offence under the Information Technology Act, 2000 and the Indian Penal Code, 1860.

3.4. The Authority reserves the right to restrict or terminate access to the Portal, in whole or in part, at any time and without prior notice, for any reason including but not limited to violation of these Terms.

4. User Accounts and Registration

4.1. Certain Services on the Portal may require you to create an account or register with valid credentials. When registering, you agree to provide accurate, current, and complete information as prompted by the registration form.

4.2. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify the Authority immediately of any unauthorized use of your account or any other breach of security.

4.3. The Authority shall not be liable for any loss or damage arising from your failure to safeguard your account credentials. You accept full responsibility for all activities that occur under your account, whether or not authorized by you.

4.4. The Authority reserves the right to suspend or terminate any user account at its sole discretion, without prior notice, if it reasonably believes that the account has been used in violation of these Terms or applicable law.

5. Intellectual Property Rights

5.1. All Content on the Portal, unless otherwise stated, is the property of the KKD eServices Authority or its content suppliers and is protected under applicable intellectual property laws of India, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

5.2. You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Portal and its Content for personal, non-commercial purposes only, subject to these Terms.

5.3. You shall not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content on the Portal without the prior written consent of the Authority, except as expressly permitted herein.

5.4. The names, logos, trademarks, and service marks displayed on the Portal are the registered and unregistered marks of the Authority. Nothing contained on the Portal shall be construed as granting any licence or right to use any trademark without the prior written permission of the Authority.

6. User Obligations and Prohibited Conduct

6.1. You agree that you shall not:

  • (a) Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable;
  • (b) Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity;
  • (c) Use any automated means, including bots, scrapers, or spiders, to access, monitor, or copy any Content from the Portal without express written permission;
  • (d) Introduce any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful;
  • (e) Attempt to gain unauthorized access to, interfere with, or disrupt the Portal, its servers, or any databases connected to the Portal;
  • (f) Use the Portal for any fraudulent purpose or in connection with any criminal offence;
  • (g) Collect or harvest any personally identifiable information from the Portal without authorization.

6.2. Violation of these prohibitions may result in civil and criminal penalties under applicable Indian law, including but not limited to the Information Technology Act, 2000 and the Indian Penal Code, 1860.

7. Limitation of Liability

7.1. The Portal and all Content, Services, and features are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2. The Authority does not warrant that the Portal will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. The Authority makes no representations regarding the accuracy, reliability, or completeness of any Content on the Portal.

7.3. In no event shall the Authority, its officers, employees, agents, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising out of or in connection with your access to or use of the Portal, regardless of the theory of liability.

7.4. The total aggregate liability of the Authority, if any, shall not exceed the amount of one thousand Indian Rupees (INR 1,000).

8. Indemnification

8.1. You agree to indemnify, defend, and hold harmless the KKD eServices Authority, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms or your use of the Portal, including but not limited to any use of the Portal's Content other than as expressly authorized in these Terms.

8.2. The Authority reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate fully with the Authority in asserting any available defences.

9. Governing Law and Jurisdiction

9.1. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

9.2. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

9.3. Notwithstanding the foregoing, the Authority retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights or other proprietary rights.

10. Modification of Terms

10.1. The Authority reserves the right to revise, amend, or modify these Terms at any time and at its sole discretion. Any changes will be effective immediately upon posting the revised Terms on this page, with an updated "Effective Date" at the top of this document.

10.2. Your continued use of the Portal after any such changes constitutes your binding acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Portal immediately.

10.3. The Authority may, but is not obligated to, provide notice of material changes to these Terms through a prominent announcement on the Portal or via electronic communication to registered Users.

11. Severability

11.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of these Terms, which shall continue in full force and effect.

11.2. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or if such modification is not possible, it shall be severed from these Terms.
